This seminar explores the crucial role of free speech in a democratic republic and the Court’s evolving
standards of jurisprudence over the past hundred years. Indeed, the First Amendment has been aptly described by Justice Cardozo as the “matrix, the indispensable condition of every other form of freedom.” Although it now enjoys a preferred place in our constitutional scheme, it has never been considered absolute. As Justice Holmes famously stated, one does not have the right “to shout fire in a crowded theatre.” The Supreme Court has balanced free speech against the competing constitutional interests of national security, state police powers, privacy, due process and equal protection. Using primary documents as the basis of our conversation, we will focus on landmark rulings involving direct incitement,hateful and offensive speech, free expression, and compelled speech.

 

This program will be conducted as a discussion, utilizing primary source documents as the only readings,
and with the Discussion Leader facilitating the conversation, instead of lecturing or presenting. Registrants, therefore, are highly encouraged to read all the documents in advance and come ready with
questions.

 

This training will be held on October 28, 2026 from 8:55 a.m. - 2:15 p.m. at the ROE #3 Professional Development Center. Registration will begin at 8:30 a.m. This event is FREE to attend and lunch will be provided. Each participant will receive 5.0 PD hours upon completion of the training.
